GENERAL CONDITIONS OF SALE

louison-bobet.com (hereafter called “the site”) is published by the Louison Bobet Company, SAS (French simplified stock company) with a capital of 230,000 euros and head office in PARIS (75011) – 7 cité de l’ameublement, identified in the RCS de Paris (Paris register of businesses and companies) under the registration n° 811 498 534. All orders made on the site are subject to current general conditions of sale. The Louison Bobet Company reserves the right to adapt or modify current conditions at any moment, the version of the general conditions applicable for all transactions being those that appear on the www.louisonbobet.com site at the time of the order.

THE CUSTOMER

The customer declares that they are a physical individual, minimum age 18 years old, and having the legal capacity or having the parental authority enabling them to make orders on the site. During registration of the customer’s personal details in the section “my account”the customer must ensure that all mandatory details given are complete and exact. In the case of error in the wording of the recipient’s contact details, the Louison Bobet Company accepts no responsibility where delivery is impossible. The Louison Bobet company reserves the right to cancel any order where the customer’s IP address is in another country from the billing or delivery address.

PRODUCTS

The products for sale are those described on the Site. The Louison Bobet Company takes care to show and describe these products to customers with all necessary information. However, small errors may appear on the Site, and customers will recognise and accept such errors. In the event that the product delivered does not conform to the description given on the Site, the Customer has the right to retract, under the guarantee of compliance of the Louison Bobet Company, who will proceed either to an exchange or a refund of the invoiced price (all or in part).

THE ORDER

All orders taken on the Site are subject to respect of the procedure set up by the Louison Bobet Company, a sequence of steps that the customer must follow in order to finalise the order. The Customer will be able to review all orders and grand total price details before finalisation, and to correct any mistakes before accepting the order. Orders confirmed by the customer are held to be a contractual agreement in which all conditions are accepted. The Louison Bobet Company will refuse an order from any customer with whom it is already engaged in litigation or any incident relating to payment of a previous order, or which contravenes the current conditions of orders. In such cases, the Louison Bobet Company will inform the customer by e-mail. If the Customer does not correct erroneous elements or elements contrary to current general conditions of sale, the Louison Bobet Company reserves the right to refuse to process the order. The Louison Bobet Company will send an e-mail to the Customer recapitulating the order including items, prices, availability of products and quantity. To this end, customers will accept the use of an e-mail address so that the Louison Bobet Company can confirm order details. Invoices will always be included in the delivery.

PRICES AND PAYMENT METHODS 

1. Determination of prices

Product prices are shown in the currency of the selected nationality, in euros or pounds sterling, including VAT and excluding shipment. The grand total cost of the order including VAT and shipment charges will appear in the basket. The Louison Bobet Company reserves the right to alter prices at any moment. Products will be invoiced on the basis of prices applying at the moment the order is placed, subject to availability.

2. Payment methods

Items are valid for payment as from the day the order is placed. Payment of purchases is effected either by bank card: The customer accesses payment via a dedicated space in a banking system, which will ensure security and register the payment order. Customers expressly acknowledge that communication of their bankcard number to Louison Bobet Company represents authorisation to debit their account in concordance with items ordered.

3. Data registered and retained by the Louison Bobet Company constitute proof of the financial transaction.

DISPATCH

Dispatch will be to the address given by the Customer, it being specified that this is the home address of the customer or of another person chosen by the customer and residing in the customer’s country of habitual residence. No deliveries will be made to hotels or Post Office Boxes.

In order for deadlines to be respected, customers must ensure that all information given regarding the address is correct and complete, and includes house number and street name, number of apartment, staircase, access codes, interphone name and/or number, etc.

Deadlines shown are indicative, and correspond to average delivery time. The Louison Bobet Company cannot be held responsible for consequences arising from delays in transit that are beyond their control. In the case of damaged packages (packages opened, missing items etc) the Customer agrees to notify the carrier and the Louison Bobet Company by all available means within three days of receipt of the product.

RETRACTION RIGHTS

Customers have a right to retract which can be effected without giving grounds within thirty (30) clear days as from delivery of the product, and which can be exercised by returning new products at their own expense in the original packaging and not worn, with the order number, to the address below:

The Louison Bobet Company will refund the customer for sums already paid, deducting postage charges, under conditions set out below.

REFUND

Product refunds will be made by the Louison Bobet Company within a maximum of 30 days following receipt of the aforementioned products. The refund will be made following the method chosen by the Customer at the time of the order.

APPLICABLE LAWS

All orders imply full adherence on the part of the Customer to the general conditions of Sale. These general conditions of Sale are governed by French law. In the case of dispute, French law courts are deemed to be the sole court of jurisdiction. Where difficulties arise or in the case of a complaint regarding an order, Customers can contact Customer Services in order to reach an amicable settlement.

DATABASE AND PRIVACY LAW

Information collected by the Louison Bobet Company in the course of an order is necessary for management of the transaction and to this end will be transferred to some or all of the Louison Bobet Company service providers operating within the framework of the implementation of the purchase order. Customers are informed that this personal data may also be collected by a body responsible for order analysis and for the fight against bankcard fraud. In accordance with the Data Protection Act of n°78-17, January 6th 1978, the customer is entitled to access, rectification, opposition and suppression of data referring to him/her.
